A wife sought monthly maintenance under Section 125 CrPC, telling the court in her pleadings and affidavits that she had no income and was destitute. The husband produced documentary evidence showing she was in fact gainfully employed and drawing a salary, which she had not disclosed to the court.

Dismissing her revision petition and upholding the trial court's rejection of her claim, the Punjab and Haryana High Court held that suppressing material facts about one's income is a decisive ground for denying maintenance. Section 125 CrPC is an equitable, welfare-oriented provision meant for a spouse genuinely unable to maintain themselves — a claimant who conceals actual employment to project false destitution is not entitled to relief under it.
