Terms of Service

By asking us to act on a request, you agree to these terms. They are short and deliberately plain.

1. What we are

MyCaseFile operates MyCaseFile, a service that obtains documents from courts, files applications, tracks case listings and performs administrative errands connected to court proceedings.

2. Advocates

Where you need legal drafting or advice, we may introduce you to an advocate enrolled with a State Bar Council. If you engage them:

• Your contract for legal services is with that advocate, not with us.
• They set and receive their own fee, agreed directly with you.
• They alone are professionally responsible for the legal work and its outcome.
• We do not supervise, direct or take a share of legal fees, and we are not liable for the advice given.

An introduction is not a recommendation of one advocate over another, and it is not an advertisement of legal services by any advocate.

3. What you are responsible for

You must give us accurate case details. A wrong case number, court or party name is the most common reason an application fails, and we cannot verify these for you — only you know your own matter. You confirm that you are entitled to obtain the documents you ask for, and that you are not asking us to obtain records you have no right to.

4. What we promise, and what we do not

We promise to file your application properly, follow it up in person, keep you informed, and deliver what the court issues.

We cannot promise timelines, because they are not ours to control. Courts, copying agencies and record rooms work at their own pace; files go missing; staff strike; complexes close. The 7–10 working days figure on this site is what we typically see, not a guarantee. We also cannot guarantee that a particular record exists or can be traced.

5. Fees

Our service fee is quoted to you before you pay and does not change afterwards for that request. Government court fees, per-page charges and courier costs are passed through at actual cost, with receipts. If actual court fees exceed our estimate, we will ask you before spending more.

5.1 We act as your pure agent for court fees

You authorise us to pay court fees, copying charges, process fees and similar statutory payments to the court on your behalf, in your name and for your account. In respect of these payments:

• We act solely as your pure agent. The liability to pay is yours; we merely discharge it for you.
• We recover these amounts from you at actual cost, without any margin or mark-up, and provide the receipts.
• These amounts are shown as a separate line on your invoice from our service fee, and are not part of the consideration for our services.
• We hold no title or interest in what is procured — the certified copy belongs to you.
• These payments are in addition to, and distinct from, the services we supply on our own account.

This reflects the arrangement between us as a matter of substance, not merely of description.

6. If we cannot deliver

If we cannot obtain the document, you pay no service fee, and we refund any court fee we did not spend. See the refund and cancellation policy for the detail.

7. Limitation of liability

Our total liability for any request is limited to the service fee you paid us for that request. We are not liable for consequences flowing from delay in obtaining a document — including a missed limitation period, a dismissed appeal or an adverse order. If a document is needed by a deadline, tell us in writing before you pay, and do not rely solely on us: file a plain-copy application yourself as a backup where the rules allow it.

8. Confidentiality

We treat your case information as confidential and handle it as set out in our privacy policy. Note that court records are, by their nature, public records — our confidentiality obligation covers what you tell us, not the underlying court file.

9. Ending the arrangement

You can stop using us at any time. We may decline or discontinue a request — refunding you in full — if the request appears unlawful, if we are asked to do something amounting to legal practice, or if we cannot serve that court.

10. Governing law

These terms are governed by Indian law. Disputes are subject to the jurisdiction of the courts at .
