The wife repeatedly demanded a separate residence away from the husband's aged parents and family members without establishing any misconduct or justifiable grievance. After reconciliation efforts failed, the husband petitioned for dissolution of marriage.

The Kerala High Court held that a wife's persistent demand for a separate residence away from the husband's family, made without sufficient or compelling reason, by itself constitutes an act of matrimonial cruelty.

Relevant provisions: Section 13(1)(ia), Hindu Marriage Act, 1955 / Section 10(1)(x), Divorce Act, 1869
