An octogenarian father executed a settlement deed and family arrangement conveying properties to his son, saying it was out of love and affection on the understanding that the son would provide basic amenities and attend to his physical needs. Alleging the son failed to care for him, he asked the Revenue Divisional Officer, acting as the Senior Citizens Tribunal, to cancel the documents under Section 23(1) of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. The Tribunal rejected the application and the District Collector affirmed that order. Before the High Court the father admitted the documents contained no specific clause requiring the son to provide amenities, but argued the obligation was implicit, relying on Urmila Dixit and S. Mala. The son relied on an express-condition requirement.

Justice Hemant Chandangoudar referred to the Full Bench decision in Sasikala v. Revenue Divisional Officer (2022), which held that the Section 23 power cannot be invoked unless the transfer document contains a specific condition requiring the transferee to provide basic amenities and physical needs, and noted that this decision had not been considered in S. Mala (2025), which accepted an implied condition. The Court held that the power to cancel could not be used here and rejected the father's plea.
