The wife, a highly qualified medical doctor, sought interim maintenance while voluntarily choosing not to work or earn income in order to financially strain the husband during litigation.

The High Court held that a highly educated and qualified spouse who deliberately refrains from working to impose an artificial financial burden on the husband is disentitled to maintenance under Section 24 of the Hindu Marriage Act.

Relevant provisions: Section 24, Hindu Marriage Act, 1955 / Section 125 CrPC
