The marriage between the parties lasted only about 57 days before the wife left the matrimonial home. She sought enhancement of her monthly maintenance from ₹8,000 under Section 125 CrPC, arguing that since the husband earned more than ₹1.5 lakh a month, she was entitled to a proportionately larger amount.
The Rajasthan High Court dismissed her revision petition, holding that maintenance cannot be fixed by a straight-jacket formula treating it as a fixed percentage of the husband's income. While the duration of a marriage does not by itself determine whether maintenance is payable at all, the Court held it is an important factor in assessing the extent of dependency and shared standard of living that developed between the parties — and where a marriage lasted barely two months, a high-earning husband's income does not automatically translate into a correspondingly high maintenance award.
