A senior citizen sought cancellation of a family property settlement deed that had been executed back in 2003, alleging neglect by the relatives who received the property, and relied on Section 23 of the Senior Citizens Act, 2007 to have it annulled. The Maintenance Tribunal cancelled the deed, and the matter came before the Madras High Court by way of writ petition.
Quashing the Tribunal's order, the High Court held that Section 23 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 applies only prospectively — to transfers made after the Act came into force in 2007. A transfer completed before the Act existed cannot be reopened or annulled under it.
