The wife lodged a cruelty and dowry harassment case against the husband and his parents. The parents faced trial first and were fully acquitted because the prosecution evidence was disbelieved. The prosecution sought to put the husband through a separate trial based on the identical evidence.
The High Court held that where the prosecution evidence against in-laws on identical allegations has already been disbelieved and resulted in acquittal, subjecting the husband to the separate ordeal of trial on the self-same evidence is futile, unjust, and an abuse of process.
