A senior citizen approached the Maintenance Tribunal under Section 23 of the Senior Citizens Act seeking cancellation of a sale deed executed between two third parties over disputed ancestral land — a dispute that turned on complex questions of title and inheritance. The Tribunal cancelled the deed, and the matter reached the Allahabad High Court.
Setting aside the Tribunal's order, the High Court held that Section 23 is a special, summary remedy meant strictly for property a senior citizen transferred themselves, subject to a condition of being maintained by the transferee. It cannot be stretched into a substitute for a civil court: the Tribunal has no jurisdiction to decide title or partition disputes, or to cancel deeds executed between parties other than the senior citizen.
