Wife Cannot Claim Shared Household Right Over Sister-in-Law's Property Under DV Act
High Court of Delhi · 2026 SCC OnLine Del 4611
The wife sought a right of residence under Section 17 & 19 of the DV Act in property exclusively owned by her sister-in-law, even after the husband had vacated the premises.
The Delhi High Court ruled that a wife entering a property solely by virtue of her husband's permissive occupation cannot claim a superior right once his licence terminates. Marital discord between husband and wife cannot penalise a sister-in-law who accommodated them in good faith.
Relevant provisions: Sections 2(s), 17, 19, & 26, Protection of Women from Domestic Violence Act, 2005
